Regulators in Poland have recently taken action against OpenAI, as the country’s Personal Data Protection Office announced on September 20th. The case involves a complaint lodged by an individual user regarding OpenAI’s popular ChatGPT app. The complainant raised concerns about the unlawful and unreliable handling of personal data by OpenAI, as well as a lack of transparency.

The individual specifically pointed out that ChatGPT generated false information in response to a query, and OpenAI failed to correct it upon request. Moreover, the user expressed uncertainty about which parts of their personal data had been processed by the AI application. Additionally, the complainant criticized OpenAI for providing evasive, misleading, and internally contradictory answers, further exacerbating concerns about the lack of transparency in its data processing principles.

Should the complaints against OpenAI hold merit, the company may have violated the European Union’s General Data Protection Regulation (GDPR) rules, which ensure the privacy and protection of personal data. OpenAI should have fulfilled its data obligations by informing the complainant about the collection of their data when it began processing it in 2021.

However, addressing the case poses unique challenges for the Personal Data Protection Office. First, OpenAI is not located within the EU jurisdiction, making it harder to enforce compliance. Second, the complaint revolves around newly-developed AI technology, further complicating the regulatory landscape.

This is not the first time OpenAI has faced scrutiny over the handling of data and transparency concerns. The increasing popularity of ChatGPT has prompted investigations and actions against the company, particularly within the EU.

In April, Italy briefly banned ChatGPT but later allowed its resumption of operations after OpenAI adapted to meet the country’s requirements. At a similar time, France received two complaints related to OpenAI, while Spain sought the assistance of EU privacy regulators to address privacy concerns involving ChatGPT. Reports from April suggested that German regulators also initiated investigations, albeit limited to a single state.

Beyond the EU, Japanese regulators warned OpenAI in June against collecting sensitive personal data in violation of local laws. Additionally, several Canadian regulators launched an investigation in May, specifically focusing on OpenAI and ChatGPT.

The regulatory case against OpenAI in Poland highlights the growing scrutiny over data handling and transparency in the field of artificial intelligence. As AI technologies continue to advance and integrate into our daily lives, it becomes imperative for companies like OpenAI to prioritize data privacy and establish clear principles for data processing.

To navigate the complex regulatory landscape, OpenAI must address the concerns raised and collaborate with regulators to ensure compliance with data protection laws worldwide.
